Part I

Scope of application

  1. GRUPA FAMILIJNA Spółka z ograniczoną odpowiedzialnością with its registered office in Kuźnica Czeszycka 11, 56-320 Krośnice being the operator of the platform for ordering the catering service available at familijna.pl, referred to as the platform for convenience, is a controller within the meaning of the Regulation of the European Parliament and of the Council (EU) of 27 April 2016. on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (for ease of reference, we will hereinafter use the abbreviation ‘GDPR’), in relation to the personal data of Users who are natural persons. This means that familijna.pl establishes the purposes and means of processing the Users' personal data on its own and at its own responsibility. If you have questions or concerns about how your personal data is protected, please contact us. Personal data is any information that can identify you, for example your first name, surname, telephone number, e-mail address and address for the performance of the Services ordered on the familijna.pl website. When we refer to the term ‘process’ or ‘processing’ in the following document, we mean any activity or operation performed on your personal data (such as storing or analysing it for the purpose of providing you with a service).
  2. The purpose of this Privacy Policy is to define the actions taken by familijna.pl regarding the protection of personal data processed, including those collected via the familijna.pl website and related services and tools used by Users to perform activities such as Registration, posting or viewing offers and performing a number of other, related activities in connection with Users' use of the platform's services. All our activities are subject to the laws that apply to data protection, for example the GDPR or the Personal Data Protection Act of 10 May 2018 (Journal of Laws 2018, item 1000). Our Privacy Policy is governed by Polish law and complies with the GDPR.
  3. We have received your personal data from you when you set up your Account and also subsequently, in connection with activities and transactions made by you in the shop using your Account and in connection with updates to your data made by you via your Account.
  4. The use of familijna.pl is possible only after reading the provisions of this Privacy Policy and the Regulations of the shop.

Part II

Processing of personal data by familijna.pl, including their acquisition and storage.

Below we have described the most frequent operations on Users' personal data, i.e. also on your personal data in connection with using the shop's services.

Account data and profile data The use of the Website requires the processing of the customer's personal data within the scope of: name and surname, telephone number, e-mail, delivery address) The data will be processed by GRUPA FAMILIJNA Spółka z ograniczoną odpowiedzialnością Kuźnica Czeszycka 11, 56-320 Krośnice, NIP (Tax ID): 9161351695, REGON (Business ID): 020182505.

If for some reason you do not provide this personal data, unfortunately we will not be able to conclude an agreement with you.

If required by law, we may require you to provide other necessary data, e.g. for accounting or tax reasons. Apart from these cases, the provision of your data is voluntary. In the case of transactions without prior registration and having an Account, it is necessary for you to provide your e-mail address and delivery address in order to conclude and perform the agreement with you. If for some reason you do not provide this personal data, unfortunately we will not be able to conclude an agreement with you.

If required by law, we may require you to provide other necessary data, e.g. for accounting or tax reasons. Otherwise, the provision of your data is voluntary.

Part III

IP address, cookies, location and mobile device identification numbers

  1. familijna.pl may collect data as part of the platform's services via such technologies as cookies, tracking pixels and objects provided locally (e.g. in the browser or on the device).

Part IV

Use of collected data

  1. familijna.pl processes (e.g. collects, stores, analyses etc.) the personal data of Users for the following purposes and on the following legal bases:
    • When it is necessary to perform the agreement concluded with you, including:
    • to enable the provision of the service electronically and the full use of the shop, including transactions and payment of sales commissions;
    • to set up and manage your User Account(s);
    • to provide support for User Accounts and Transactions on the familijna.pl platform, including the resolution of technical problems;
    • to contact the Users, including for the purpose of providing services, User support, through available communication channels, in particular e-mail, telephone and social media channels (e.g. Facebook Messenger, Instagram);
    • to handle complaints.
  2. If an obligation to process exists under applicable law, which includes processing for tax and accounting purposes, including ensuring accountability, i.e. being able to demonstrate that:
    • the personal data is processed lawfully, fairly and in a transparent manner for the data subject,
    • the purpose of the processing is clearly specified,
    • the data processed is adequate, relevant and limited only as regards the purposes of the processing,
    • personal data shall be accurate and, if necessary, kept up to date,
    • the personal data is processed in a way which ensures appropriate security,
    • and that the storage of the data is limited to the strict minimum necessary for the purposes for which the data is processed.

Part V

Users' rights with regard to data processing and their exercise

  1. We guarantee the fulfilment of all your rights under the GDPR, i.e. the right to access your data and obtain a copy of your data, to rectify and erase your data, to restrict the processing of your data, the right to data portability, and the right to object to the processing of your personal data, as well as when your data is processed for direct marketing purposes, including being profiled for that purpose.
  2. You can exercise the right to rectification if you notice that your data is incorrect or incomplete.
  3. You can exercise the right to erasure: if your data is no longer necessary for the purposes for which it was collected by the Company; you withdraw your consent to the processing of your data; you object to the processing of your data; your data is being processed unlawfully.
  4. You can exercise your right to restrict processing if you notice that your data is inaccurate - you can request a restriction of the processing of your data for a period of time allowing us to check the accuracy of the data; your data is being processed unlawfully but you do not want it to be deleted; your data is no longer necessary for us but may be necessary for you to defend or assert your claims; or you object to the processing of your data – until we determine whether the legitimate grounds on our side override the grounds for the objection.
  5. You can exercise your right to data portability if the processing of your data is based on your consent or an agreement with you, and if the processing is automated.

Remember also that you have the right to lodge a complaint in relation to our processing of your personal data with the supervisory authority, which is the President of the Personal Data Protection Office (address: President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw).

Data sharing

  1. We share your personal data with the parties of transactions you conclude on familijna.pl and entities supporting us in the provision of electronic services, i.e. those providing payment services.
  2. As part of the adopted Privacy Policy, familijna.pl undertakes not to sell Users' personal data. In the case of restructuring or sale of the conducted business or its part and transferring all or a significant part of its assets to a new owner, Users' personal data may be transferred to the buyer.

Do we transfer your data to countries outside the European Economic Area?

Your personal data shall NOT be transferred outside the European Economic Area.

Part VIII

Retention period of your personal data

  1. We keep your personal data for the duration of the agreement concluded with you and also after its termination for the purposes of:
    • the performance of legal obligations, including in particular tax and accounting obligations,

    • prevention of fraud and abuse,

    • statistical and archiving purposes,

    • for a maximum period of 3 years from the end of the year in which the agreement is terminated, and in the case of a transaction made without prior registration and creation of an account, for

    • a maximum period of 2 years counted from the date of conclusion of a sales agreement, which occurs as a result of making a transaction without prior registration and having an account at familijna.pl.

    • in order to document the fulfilment of legal requirements and enabling control of their fulfilment by public authorities.
